Exclusion of the right of withdrawal
The statutory right of withdrawal pursuant to §§ 312g, 355 BGB applies exclusively to consumers within the meaning of § 13 BGB. The right of withdrawal is expressly excluded for orders placed by entrepreneurs within the meaning of Section 14 BGB, i.e. natural or legal persons or partnerships with legal capacity who are acting in the exercise of their commercial or independent professional activity when concluding the legal transaction.
Entrepreneurs are therefore not granted a right of withdrawal. Every order placed by entrepreneurs is binding and obliges them to accept the ordered goods.
